NOTICE OF APPLICATION TO ENTER YAKIMA ADJUDICATION COURT CLAIM NO. 00383 (S4-83722-J AND S4-83724-J) INTO THE STATE TRUST WATER RIGHT PROGRAM

TAKE NOTICE:

 

That on July 7, 2017, The Trust for Public Land, Seattle Washington, filed application numbers CS4-00383sb3(A)@7 and CS4-00383sb3@7(A) in coordination with Washington Water Trust and Kittitas County with the Department of Ecology to change the purpose of use and place of use under S4-83722-J and S4-83724-J (Court Claim 00383).

That said rights, under priority dates of June 30, 1888 and June 30, 1889, respectively, authorize the diversion of 1.1 cubic feet per second and 207 acre-feet per year (cumulatively) from the Teanaway River and two unnamed tributaries to the Teanaway River from points located within the S½ and SW¼ NE¼ of Section 10, T. 20 N., R. 16 E.W.M.

That said rights authorize water to be used for irrigation of 50 acres from May 1 through September 15 and stockwater within:

  • Those portions of the SW¼NE¼ and NW¼SE¼ of Section 10, T. 20 N., R. 16 E.W.M. lying northerly of the Teanaway River and southerly of the Teanaway Road, EXCEPT that portion of the SW¼NE¼ of said Section 10 lying northwesterly of the following described line: Beginning at a point on the north line of said SW¼NE¼ that is 275 feet west from the northeast corner of said SW¼NE¼ and thence running southwesterly to a point on the south line of said SW¼NE¼ that is 400 feet east of the southwest corner of said SW¼NE¼, which is the terminus of said described line. AND EXCEPT that portion of the NW¼SE¼ of Section 10, T. 20 N., R. 16 E.W.M. lying southeasterly of the following described line: Beginning at the northeast corner of said NW¼SE¼ and thence running southwesterly to the southwest corner of said NW¼SE¼, which is the terminus of said described line; and
  • That portion of the SE¼SW¼NE¼ of Section 10, T. 20 N., R. 16 E.W.M. lying north of the Teanaway Road

That the applicant proposes to change the entirety of the rights as follows:

  • the purposes of use to instream flow and mitigation; and
  • the places of use to two unnamed tributaries of the Teanaway River and the Teanaway River, beginning at the historical points of diversions to the Yakima River, and in the Yakima River, beginning at the confluence with the Teanaway River to the Columbia River.

Protests or objections to approval of this application must include a detailed statement of the basis for objections. All letters of protest will become public record. Cash shall not be accepted. Fees must be paid by check or money order and are nonrefundable. Protests must be accompanied by a $50 recording fee payable to the Department of Ecology, Cashiering Unit, PO Box 47611, Olympia WA 98504-7611, within 30 days from: November 10, 2017.
