Is there a deadline for submitting the petition for reducing assessed values?
The sooner the better. Timely filing will result in more rapid tax refunds, if applicable, and allow values to be adjusted as soon as possible. However, the statutory basis for the petition, RCW 84.40.039 Going off site, allows owners to petition anytime within three years of the adoption of a restriction. The initial DOE emergency rule that closed Upper Kittitas County to all new groundwater withdrawals became effective July 16, 2009.

How do I determine whether or not my parcel lies within the DOE water management boundary?
Go to COMPAS, Kittitas County's mapping application at http://gis.co.kittitas.wa.us/. Under Table of Contents, check the "State of WA Dept of Ecology (DOE) Upper Kittitas Ground Water Withdrawal Rule 173-539A WAC" box and the "Boundary for DOE Upper Kittitas County Ground Water Withdrawal Restriction" box. This boundary layer will be overlaid on the parcel layer when you use the Search Option and find your parcel. There is a Help Option to assist your navigation in COMPAS.
Does property have to be located within the boundary of where DOE has restricted groundwater withdrawal in order to qualify for a reduction in assessed value pursuant to RCW 84.40.039 Going off site?
Yes. Property must be located within the boundary of the area where groundwater withdrawal has been restricted by DOE's rule in Chapter 173-539A WAC: http://www.ecy.wa.gov/laws-rules/wac173539a/x1012a.pdf Going off site as illustrated on Kittitas County's mapping application, COMPAS: http://gis.co.kittitas.wa.us/.
Where do I obtain a Petition for Reduction in Assessed Value Pursuant to Adoption of a Restriction by a Government Entity?
You can use the fill-in version at the bottom of this web page or you can request a form by calling the Assessor's Office at 509-962-7501 or toll free from Upper County at 509-674-2584, extension #501.
How and where do I submit the petition?
Petitions must be signed by the property owner under penalty of perjury. Then submit completed petitions to the Assessor's Office in one of the following manners:
a) Mail to the address listed on the petition: Kittitas County Assessor, 205 W 5th AVE, STE 101, Ellensburg, WA 98926
b) Fax to the fax number listed on the petition: 509-962-7666
c) Scan and email to the email listed on the petition: assessoradmin@co.kittitas.wa.us
d) Bring the form in to the Kittitas County Assessor's Office at the above address
How will I know if my petition has been approved or denied?
If approved, you will be mailed a Change of Value Notice. If denied, you will receive written notification.
How much of a reduction will the property receive?
Petitions must be reviewed before a reduction amount is determined. Factors taken into consideration include parcel location, parcel size and an established water source including a water right or a water source put to beneficial use.
What types of property are most likely to qualify for a reduction in assessed value?
Parcels that may qualify include bare land without an established water source including a water right or a water source put to regular beneficial use located in the upper Kittitas County area described in Chapter 173-539A WAC Going off site. For a map delineating the upper Kittitas County area, go to the Kittitas County website GIS mapping application, COMPAS: http://gis.co.kittitas.wa.us/.
What types of property are most likely to not qualify for a reduction in assessed value?
Parcels that will most likely not qualify include those with dwellings or bare land with an established water source including a water right or a water source put to regular beneficial use.
How do I know if I have an established water source and/or if I have put the ground water exemption to beneficial use?

Seek legal advice for your questions regarding beneficial use and how that might apply in your situation. For questions about water rights and water right transfers, please contact DOE.
Where can I find information on the Upper Kittitas County Water Exchange program offered by Department of Ecology?
Department of Ecology has set up the Upper Kittitas Water Exchange as a service to help water users locate or sell water available for transfer. More information is available on the DOE website at http://www.ecy.wa.gov/programs/wr/cwp/wtrxchng.html Going off site.
Is there information available on whether or not parcels are likely to be given approval to purchase water from the Upper Kittitas County Water Exchange?
Yes, DOE has developed a Registry of Ecology Approved Water Rights and a corresponding "Suncadia Mitigation Suitability Map" on which they have identified the areas where these rights are likely to be best suited as mitigation at http://www.ecy.wa.gov/programs/wr/cwp/wtrxchng_cert.html Going off site. This information will evolve as additional water rights become available.
This "Suncadia Mitigation Suitability Map" is also available on the Kittitas County mapping application, COMPAS. Kittitas County will update this map as new information is received from DOE. Go to http://gis.co.kittitas.wa.us to overlay the mitigation map over the parcel layer. Check the "State of WA Dept of Ecology (DOE) Upper Kittitas Ground Water Withdrawal Rule 173-539A WAC" box, then check the "Suncadia Mitigation Suitability Map" box. The suitability layer will be overlaid on the parcel layer when you use the Search Option and find your parcel. There is a Help Option to assist your navigation in COMPAS.

Petition

Property owners may petition the Assessor for a reduction in the assessed value of real property within three years of adoption of a restriction by a government entity based on RCW 84.40.039 Going off site. A petition was developed to aid taxpayers that want to report how Washington State Department of Ecology's rule for managing underground water resources in Upper Kittitas County has restricted the use of their property resulting in a reduction in value.

Completed petitions must be submitted to the Assessor's Office. Please note the instructions on the form:

  • Incomplete petitions will be returned to sender without any action
  • Only one parcel per petition is allowed
  • The petition must be signed by the owner under penalty of perjury
